1. Acceptance of Terms

By downloading, installing, or using PR Days - Act 60 Tracker ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Portal.PR ("we", "us", or "our").

2. Description of Service

PR Days is a personal tracking tool designed to help individuals monitor their physical presence in Puerto Rico for Act 60 tax compliance purposes.

What the App Does:

Tracks your location to detect Puerto Rico boundary crossings
Records arrival and departure events
Calculates days spent in Puerto Rico
Stores data locally on your device
Exports data to CSV format

What the App Does NOT Do:

Provide legal or tax advice
Guarantee accuracy of calculations
Replace professional tax consultation
Serve as official documentation for tax purposes
Connect to government systems or databases

4. User Responsibilities

You Are Responsible For:

Keeping your device secure and protected

You Agree NOT To:

Use the app for any illegal purpose
Attempt to reverse engineer, decompile, or hack the app
Use the app to provide services to third parties
Misrepresent data or calculations from the app
Rely solely on the app for tax compliance decisions
Hold us liable for any inaccuracies or errors

5. No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do NOT warrant that:

The app will be error-free or uninterrupted
Location tracking will be 100% accurate
Calculations will be correct or reliable
The app will meet your specific requirements
Data will never be lost (always maintain backups)
The app will remain available indefinitely

Location tracking technology has inherent limitations. GPS signals can be affected by weather, buildings, device hardware, and other factors. Always verify important events manually.

6. Limitation of Liability

MAXIMUM LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTAL.PR AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY:

Tax penalties or fines resulting from inaccurate tracking
Financial losses due to miscalculations or errors
Legal consequences from reliance on app data
Loss of data or inability to access data
Indirect, incidental, special, or consequential damages
Any damages exceeding $0 (zero dollars)

You acknowledge that you use this app entirely at your own risk and that we bear no responsibility for any consequences arising from your use of the app.

7. Intellectual Property

The app, including its code, design, graphics, and content, is owned by Portal.PR and protected by copyright and other intellectual property laws.

Your Data: You retain all rights to your location data and tracking information. Since all data is stored locally on your device, you have complete ownership and control.

License: We grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

8. Data Management

Local Storage: All your tracking data is stored locally on your device. We do not have access to your data, and we cannot recover it if you lose it.

Your Responsibility: You are solely responsible for:

Backing up your data (via CSV export or device backup)
Verifying data accuracy before using it for tax purposes
Securely storing exported data files
Deleting data when no longer needed

Data Loss: We are not responsible for any data loss resulting from device failure, app uninstallation, OS updates, or any other cause.

9. Modifications to Service

We reserve the right to:

Modify or discontinue the app at any time without notice
Update these Terms at any time (check for updates regularly)
Change app features, functionality, or availability
Cease development or support at our discretion

Continued use of the app after changes constitutes acceptance of modified Terms.

10. Termination

You may terminate your use of the app at any time by uninstalling it from your device.

We may terminate or restrict your access to the app at any time, for any reason, without notice or liability.

Upon termination, all licenses granted to you will immediately cease, and you must stop using the app.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Commonwealth of Puerto Rico and the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the app shall be resolved exclusively in the courts located in San Juan, Puerto Rico.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Portal.PR regarding the app.
